Defense attorneys in the #Freeway9 trial have just received previously withheld recordings from the prosecution. These recordings were made in 2017, when the Anti-Terrorist Division of the LAPD sent a confidential informant into meetings of Refuse Fascism. The recordings indicate LAPD attempted an entrapment operation. Their confidential informant said in an open meeting “I don’t like Trump and what he’s doing, ruining our country…you can give me a gun any day, I’ll shoot them.” A Refuse Fascism activist immediately responded “this is not what we are about”. (RefuseFascism.org is an explicitly non-violent organization)
This quote and others are the basis of a new motion to dismiss on the basis of outrageous police conduct and illegal political persecution. This motion along with a Murgia (selective prosecution) motion and related motions will be heard on Friday March 6 at 8:30 am. Because of a court protective order, these recordings are not available to the public or press. It appears portions of the recordings, including statements made by CI, may be read as part of oral arguments in court on Friday. To record the hearing, interested media should contact Department 74 of the Metropolitan Courthouse (1945 South Hill Street) where the proceedings will be held.

Who are the #Freeway9?
In 2017 members of Refuse Fascism and the Revolution Club were a part of actions meant to sound the alarm against a rapidly advancing fascism and modeling the kind of determined protest that is required to stop it blocking morning rush hour traffic on the 101 Freeway in Los Angeles with a 50-foot banner, twice. These defendants have come to be known as the #Freeway9. For almost 2.5 years now the LAPD and the Democratic LA City Attorney’s office has relentlessly targeted, surveilled, harassed, and prosecuted these brave heroes filing 57 charges against 11 people with penalties that tallied up to almost 5 years of jail time.
