Refuse Fascism May 15 Hands Off Birthright Citizenship Statement

Today, the Trump fascist regime is arguing in front of the Supreme Court that they should be allowed to destroy the Constitutional right to Birthright Citizenship. That the Supreme Court is even entertaining this blatantly unconstitutional proposition is outrageous and illegitimate.

On his first day in office, Trump issued an executive order (Executive Order 14156) claiming to strip away the fundamental right to Birthright Citizenship – a shameless attack on the U.S. Constitution the rule of law, the separation of powers, and the lives of countless people. Birthright Citizenship means that every person born in the United States automatically becomes a citizen of the United States. It is written into the 14^th Amendment of the Constitution and was won through the Civil War to grant citizenship to formerly enslaved people.

Everything about Trump’s executive order is illegitimate.

Every day, Trump takes another step—another leap—towards bolting fascism into place. Last Friday, ICE arrested Ras Baraka, the mayor of Newark, NJ, as he asked to carry out a legal inspection of an immigration jail in his city. On Sunday, Trump said that he “didn’t know” if the Constitution guarantees due process for individuals accused of crimes—“due process”(!) which is the very bedrock of the rule of law, and the Constitution! Then on Thursday the Supreme Court seriously debated whether federal courts could prevent Trump from using a presidential order to abolish the constitutionally guaranteed right to Birthright Citizenship!
